Whether the Constitution ultimately permits or forbids the filing of a non-bailable criminal case against a sitting impeachable officer is therefore less a static rule than an emergent property of the institutional contest itself.
The premise is thus not merely predictive; it is diagnostic of a living constitutional tension. The subpoena to Tupas is one more datum in that ongoing experiment: an attempt to ascertain, through the machinery of investigation and the threat of non-bailable process, whether the shield of impeachability is absolute during tenure or whether the criminal law may pierce it at any moment. The answer, when it finally crystallizes, will redefine the practical meaning of “sitting impeachable officer” in Philippine constitutional practice.
